Since David Prosser’s temperament became a leading issue in the race for his seat on the Supreme Court, he’s taken a few lumps – but enjoyed some renewed support, as well.
Most painfully for Prosser, former Gov. Pat Lucey, a Democrat, announced last week that he was stepping down as one of the honorary co-chairs of the incumbent justice’s campaign. In a statement, Lucey questioned Prosser’s impartiality (if reelected, he could rule on cases deciding the fate of Gov. Scott Walker’s union limits) and his general demeanor.
Lucey took issue with “a disturbing distemper and lack of civility that does not bode well for the high court in the face of demands that are sure to be placed on it in these times of great political and legal volatility.”
This doesn’t help with moderate or conservative Democrats. “I have worked hard to garner bi-partisan support in an increasingly challenging environment,” Prosser said in response, although the justice notes he still has “admiration and respect” for the former governor.
Prosser has taken flak over his personal style since it was reported he called Chief Justice Shirley Abraham “a total bitch” during a non-public meeting last year.
But a letter from a dozen attorneys who formerly served as Prosser law clerks paints a vastly different picture of the high court judge. “His attention to detail, intelligence, pleasant demeanor and thoughtful analysis are important assets to the institution and function of the Supreme Court,” says a statement from the group. “His tireless dedication to the people of the State of Wisconsin is both touching and honorable.”
Another Prosser fan is Sarah Palin, who, on her Twitter account, reminded Wisconsinites last week “to vote for Justice Prosser on April 5.”
